1.This website is operated by Dami and Em Design Ltd. Where these terms and conditions use terms such as "we", "us" and "our" they refer to Dami and Em Design Ltd.

2.This website, including all the information and products available on it, is to be used only on the condition that you accept these terms and conditions and the associated privacy policy available on our website. 

3.By visiting our website and/or purchasing something from us, you are deemed to have accepted these terms and conditions. 

4.You can view the most current version of these terms and conditions at any time by visiting this website page. We reserve the right to update, change, or replace any part of these terms and conditions, without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit to your website, read these terms and conditions, and ensure you understand them before making a purchase.

 

GENERAL CONDITIONS

5. We reserve the right to refuse service to anyone, for any reason, at any time. 

6. Any content that you enter onto this website may be transferred unencrypted and involve transmissions over various networks and may involve changes in order to conform and adapt to the technical requirements of connecting networks or devices. 

7. You may not reproduce, duplicate, copy, sell, resell or otherwise exploit for commercial gain, or otherwise, any portion of any of the content on the website or any other part of the service that we offer on this website. 

8. Headings and titles used on this website are done so for convenience only. They do not constitute any part of the terms and conditions and will not limit or otherwise affect the terms herein. 

 

ONLINE STORE TERMS

9. Our website offers a range of products and services for sale. Where we refer to an 'item,' we are referring to a single product or service available for purchase on this website. 

10. We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system. 

11. While care is taken to ensure that we display appearances, colours, textures or finishes as accurately as possible, what you will see on your computer monitor or equipment may differ, and so we cannot guarantee that images are an accurate representation of the actual goods or services that you are purchasing.

12. We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:

i) The item you have ordered is out of stock

ii) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent

iii) There has been a pricing or product description error

iv) There is a system or procurement failure

v) You have failed our customer validation checks

13. When you place an order, you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.

 

PRICES AND PAYMENT

14.The prices of services and products advertised for sale on our website are as set out on our website. All prices are in pounds (£) sterling, inclusive of VAT (tax breakdown will be shown on checkout), exclusive of shipping charges. Shipping charges will be added to the total amount due once you have selected a shipping service from the available options.

16.We cannot accept your order until you have paid for it in full.

17. In the unlikely event that the price of an item has been incorrectly advertised, we will contact you by email or telephone to ask whether you wish to proceed with the order at the correct price. If you are not happy to proceed, or we are unable to obtain your instructions, we will cancel the order. Unless we have already confirmed dispatch of your order, we will not be obliged to supply services at the incorrect price.

 

MODIFICATIONS TO OUR SERVICE AND PRICING

18. Prices for items are subject to change without notice. Prices may change at any time prior to (but not after) acceptance of your order.

19. We reserve the right to, at any time, modify or discontinue any part of the service that we offer, or any part of content thereof, without any notice to you. 

20. We accept no liability to you or to any third-party for any modification, price change, suspension, or discontinuation of the service. 

 

DELIVERY

21. During checkout, you may be presented with one or more options for delivery. Where an estimated timescale for delivery is provided, this is an estimate only and your items may be delayed in being received due to circumstances beyond our control (such as a courier delay, or at busy times). Delivery dates are not guaranteed but we will do our utmost to ensure goods are delivered within the stated date or soon afterwards. If you have not received your order within 7 days after the specified delivery timeframe, please contact us at info@damiandem.com to investigate the non-arrival.

22.We carry the risk of loss or damage to the products until you receive them. The products belong to you when you have received them and have paid us in full. If you return the products to us for any reason, they will become our property and be at our risk from the time we receive them.

23.We ship worldwide, and you can place your order as usual on our website. Please note that tax and duty charges, which are country specific, will be charged by the courier upon goods entering the country and are the responsibility of the customer to pay. The courier will contact you to pay the customs charges prior to making the delivery. If payment is not made promptly then the goods will be returned to us. In this instance, please note that Dami and Em Design Ltd will not be able to refund the delivery cost, nor pay for re-delivery of goods.

 

ORDER CANCELLATION, REFUNDS & RETURNS

24. If you wish to cancel an order you have placed, you must contact us immediately at info@damiandem.com to ascertain whether the items have been dispatched or not. Where they have been dispatched, you will need to return the item to us, and you will be responsible for paying the cost of returning the items.

25. Where items have not been dispatched prior to a cancellation request, our refund policy will apply (25).

26.General cancellation terms - 14 days of receiving the product. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

27.Refunds are accepted if goods are returned in a resaleable condition in the original packaging within 14 days of receiving your goods. Once we receive your returned order safely, we will issue a refund to your original payment method within 7 days.

  • To be eligible for a return, your item must be unused, and in the same condition that you received it. It must also be in the original wrapping and packaging. 

  • You will be responsible for paying your own shipping costs for returning your order. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

  • All products should be inspected prior to hanging. No claim can be accepted after wallpaper has been cut and hung, our responsibility is limited to the cost of the replacement wallpaper.

Exclusions:

  • Unless faulty, we are unable to offer refunds on fabrics as they are printed and cut to order

  • Unless faulty, wallpaper can only be returned and refunded if packaging is unopened.

  • Unless faulty, we are unable to offer refunds on lampshades as they are made to order.

  • We do not accept returns on samples.

  • We do not accept returns for extra fabric or wallpaper left over after finishing a project.

  • Please note that all bespoke products are non-returnable. 

 

Your statutory rights to refund or exchange still apply if the goods are faulty or not as described.

If any product you purchase is damaged or faulty when delivered to you, we may offer a repair, exchange, or refund as appropriate, in accordance with your legal rights. If you believe a product is faulty, you should notify us to arrange for the return of the product(s) as per above cancellation and returns policy.

 

Returning by post:

Send us an email to info@damiandem.com within 14 days of receipt. Please provide the following information:

  • State your name, address, date of purchase, order number and items purchased (product name and quantity)

  • Indicate if you would rather exchange the goods or receive a refund, and the reason for the exchange or refund.

Send us the product within 14 days.

 

​To make a return or exchange we need to receive the product back in an unused, unopened, and resalable condition, in its original wrapping / packaging. Refunds will be given only after we have received and inspected the product. 

You must send your returns using a recorded or signed for service, and retain the proof of postage.

 

Faulty Products

We will make every effort to ensure you receive exactly what you have ordered in perfect condition, however if you receive a faulty or damaged order please inform us immediately, or anytime up to 14 days of receipt by email to info@damiandem.com.

Please include your order number in all communications. Once the damage is verified we will arrange a refund or exchange.

LIABILITY AND INDEMNITY

28. We shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.

29. You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.

 

JURISDICTION

30. These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.

 

ENTIRE AGREEMENT

31. These terms and conditions combined with our published Privacy Policy (also available through this website) constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and us whether written or oral.

 

GENERAL

32. Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.

33. Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.
